By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site on devices you own or manage. You are solely responsible for maintaining the confidentiality of your account credentials.

SECTION 2 – PRODUCTS AND ACCURACY
We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be completely accurate. We do not warrant that the quality, appearance, or specifications of any products purchased by you will meet your subjective expectations. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

SECTION 3 – ORDERS AND PRICING
By placing an order, you are making an offer to purchase. KES Love reserves the right to accept or decline your order at our sole discretion for any reason. Prices displayed do not include taxes (such as US Sales Tax), shipping and handling charges, or duties, which will be calculated and added during the checkout process where applicable.

SECTION 4 – INTERNATIONAL SHIPPING AND RISK OF LOSS
All products are shipped internationally from Ukraine. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments caused by carriers, customs clearance, or events beyond our reasonable control, including but not limited to acts of God, war, military operations, national emergencies, or logistical disruptions. The risk of loss and title for items purchased pass to you upon our delivery of the items to the shipping carrier. Returns and exchanges are governed exclusively by our Return Policy.

SECTION 5 – THIRD-PARTY RELATIONSHIPS (SHOPIFY)
KES Love is hosted on the Shopify platform. However, all sales and transactions are directly between you and KES Love. You expressly acknowledge and agree that Shopify Inc. and its affiliates are not responsible for any aspect of the transactions, sales, injuries, losses, or damages arising from your use of the Services. You hereby release Shopify from any and all claims, liabilities, and damages arising out of your interactions with KES Love.

SECTION 6 – PROHIBITED USES AND AUTOMATED AGENTS
You are prohibited from using the site or its content for any unlawful purpose, or to crawl, scrape, extract, or data-mine the Services using any automated means, including spiders, robots, or AI/LLM tools, unless expressly permitted by us in writing. If you utilize an automated software "Agent" to interact with the Services, the Agent must identify itself clearly in the HTTP/HTTPS request header via a standard User-Agent string (e.g., Agent/[Agent Name]).

THE SERVICES AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICES ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

SECTION 8 – LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE SHALL KES LOVE, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS, OR SHOPIFY INC., BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

SECTION 9 – DISPUTE RESOLUTION AND BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
9.1 Informal Dispute Resolution: You and KES Love agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the purchase of any products, will first be negotiated informally for at least thirty (30) days before initiating any formal proceedings. Informal dispute notices must be sent via email to info.keslove@gmail.com.
9.2 Binding Arbitration: If the dispute cannot be resolved informally, you and KES Love agree that any and all disputes shall be resolved exclusively through final and binding arbitration, rather than in a court of law. The arbitration shall be conducted in the English language, on an online/virtual basis, and administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, or another internationally recognized arbitration body agreed upon by both parties.
9.3 CLASS ACTION WAIVER: YOU AND KES LOVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

SECTION 10 – GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, enforced, and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service that is not subject to arbitration under Section 9 shall be instituted exclusively in the competent courts of Ukraine.

SECTION 11 – SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
